1. Acceptance of Terms

By accessing and using VisaMate ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

These Terms of Service ("Terms") govern your access to and use of the VisaMate platform, including all features, content, and services provided by VisaMate ("we," "us," or "our").

2. Description of Service

VisaMate is a software platform designed to assist immigration law firms and legal professionals in managing EB-1A and NIW visa cases. The Service includes:

  • Case management and organization tools
  • Evidence binder and document management
  • Petition letter drafting assistance
  • Risk assessment and criteria evaluation tools
  • Filing package compilation features

Important: VisaMate is a technology tool and does not provide legal advice. The Service is intended to assist legal professionals and is not a substitute for professional legal judgment.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts. By using the Service, you represent and warrant that you meet these eligibility requirements.

4. Use of Service

The Service and its original content, features, and functionality are owned by VisaMate and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you upload or create using the Service ("User Content"). By using the Service, you grant VisaMate a limited, non-exclusive, worldwide, royalty-free license to use, store, and process your User Content solely for the purpose of providing and improving the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

6. Payment Terms

6.1 Pricing

The Service is offered on a per-case basis. Pricing is displayed on our pricing page and may be updated from time to time. We reserve the right to change our pricing with 30 days' notice.

6.2 Payment Processing

Payments are processed through third-party payment processors (e.g., Stripe). By making a payment, you agree to the payment processor's terms and conditions.

6.3 Refunds

Refund policies are outlined in our pricing terms. Generally, refunds are not available for completed cases, but we may offer refunds at our discretion for exceptional circumstances.

6.4 Free Trial

We may offer a free trial period. During the trial, you can use the Service with limited features. No payment is required during the trial period.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or use of your account.

8. Disclaimers and Limitations of Liability

8.1 No Legal Advice

VisaMate does not provide legal advice. The Service is a technology tool designed to assist legal professionals. All content generated by the Service should be reviewed and approved by a licensed attorney. VisaMate is not a law firm and does not provide legal representation.

8.2 Service Availability

We strive to maintain the Service's availability but do not guarantee uninterrupted or error-free operation. The Service is provided "as is" and "as available" without warranties of any kind.

8.3 Limitation of Liability

To the maximum extent permitted by law, VisaMate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless VisaMate and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or using the account deletion feature in your settings.

Sections of these Terms that by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law and Dispute Resolution
